Activities of Upzila Parishad

1. Short title: These rules may be called Upazila Parishad (Activities Implementation) Rules, 2010.

2. Upazila Parishad meeting (1) First meeting: After taking oath in accordance with the provisions of section 18 of the Act, the Upazila Nirbahi Officer of the concerned Upazila, in consultation with the Chairman, shall convene the first meeting of the Parishad. (2) General and emergency meetings (A) Subject to the rules of law, the council may determine the procedure of its meetings. (B) The meeting of the council shall be held on the date, time and place fixed by its chairman, but unless a different decision is given by the chairman, each meeting shall be held at the office of the council. (C) A meeting of the council shall be held at least once a month. Provided, however, that an emergency meeting of the council may be called upon 24 (twenty-four) hours' notice to carry out the special functions of the council. (D) Notice of the meeting shall be given at least 7 (seven) days before the date of the meeting. (E) Notice issued for the date, time and place of the meeting shall be mentioned by the Upazila Nirbahi Officer and a copy of the said notice shall be sent to the concerned Member of Parliament and Deputy Commissioner for information. (F) With the notice of the meeting or approximately 72 (seventy two) hours before the date of the meeting, all the necessary documents must be provided to the members, but the time limit will not be applicable in case of emergency meeting.

3. Conducting meetings (1) The Chairman shall preside at all meetings of the Council and in his absence the Vice-Chairman shall preside at the meetings subject to the provisions of section 15. (2) No matter shall be accepted for discussion except worksheet. (3) As proof of attendance at the meeting, the attendance book, if any, of the members and the public present shall be signed, which shall always be preserved by the Secretary and shall be considered as part of the minutes of the said attendance meeting. (4) If any relative, friend or acquaintance of a member is involved in any of the matters in question, such member shall inform the Chairman before the commencement of the meeting and shall not be present at the meeting during the discussion of the matter. He will then be able to attend the meeting. (5) During the discussion, before taking the vote, if any person expresses his desire to present his statement, the Chairman shall give that person the opportunity to present his statement and the members or the Chairman may question that person. (6) Each member shall have one vote and in case of equality of votes, the person presiding over the meeting shall have the power to cast a second or casting vote. (6) In accordance with the provisions of section 26, to assist the council in giving opinion on any matter to be discussed or disposed of in the meeting, they shall attend the main meeting of all the departments assigned under the third schedule, but they shall not have any voting right. (6) For the purpose of complying with the provisions of sub-section (2) of section 26, the council may invite any person in any of its meetings to give an opinion on a particular subject. (9) If a meeting fails to decide on any of its issues, the matter shall be included in the agenda of the next meeting for discussion. (10) If any meeting is not concluded, the President shall adjourn the meeting and announce the date, time and place of the next meeting.

4. Disposable functions of the meeting: In order to discuss and take a decision, the following financial, developmental, operational, coordination and miscellaneous issues shall be presented in the meeting of the council without violating the provisions of law. E.g.

Financial (1) All matters relating to council funds. (2) Proposal to impose taxes, rates, tolls and fees under the control of the council. (3) Annual budget statement of the council. (4) Annual revised budget of the council. (5) The proposal for such expenditure is not included in the current year's budget. (6) Annual statement of accounts of the council. (6) Approval of work quality and estimate to be implemented by the council. (6) Proposal regarding investment of funds of the council. (9) Audit of the expenditure of the council.

Developmental: (1) Approval of transferred development proposals / projects and estimates. (2) Preparation and updating of the five-year and annual development plan and plan book of the council. (3) To review, monitor and evaluate the monthly progress of all types of development works implemented by the funds of the council. (4) All other development projects assigned to the council by the government from time to time.

Operational (1) Matters relating to all officers and employees of the council, including officers and employees assigned / deputed to the council by the government. (2) To review and approve the recommendations of the Standing Committee constituted under section 29 and to form various committees in the light of such recommendations and to approve its Terms of Reference. (3) Reviewing and approving the proposal or, as the case may be, the recommendation made by the Vice-Chairman.

Adjustment: (1) Monthly review of development activities of various non-governmental voluntary organizations (NGOs) operating within the offices and geographical jurisdiction of the Upazila handed over to the Parishad along with performance report and collection of statements and sending such reports to all concerned as per law. (2) Quarterly review the activities of the Regulatory Department of the Government including collection of reports and statements and sending all reports to all concerned as per law.
